- Obtener un Número de Identificación Fiscal (N.I.F.) para entidades no residentes;
- Obtain a VAT number for non-resident entities;
- Obtener un Número de Identificación Fiscal (N.I.F.) para personas físicas sin DNI/NIE.
- Obtain a tax identification number for private individuals with no DNI/NIE.
- Actuar como representante a efectos del cumplimiento de las obligaciones del artículo 164.Uno.7 de la Ley 37/1992, de 28 de diciembre, del Impuesto sobre el Valor Añadido.
- Act as representative for the purposes of fulfilling the obligations of article 164.One.7 of Law 37/1992, of 28 December, on Value Added Tax.
- Preparar, firmar y presentar telemáticamente con el certificado de usuario de Erica Eced Martinez declaraciones de IVA, solicitudes de devoluciones de IVA mensuales, preparación de modelos 349 e Intrastat, modelo 347 y cualesquiera que sean otros modelos entre ellos los de inicio y fin de actividades (modelos 036);
- Prepare, sign and submit electronically, using the user's certificate of Erica Eced Martinez, VAT Returns, Monthly VAT refunds, EU Sales lists (form 349), Intrastat returns, 347 forms and other VAT forms where necessary, amongst them, those related to the beginning and end of activities (forms 036);
- Erica Eced Martinez con D.N.I 35594222C podrá solicitar y gestionar cuantos documentos públicos y/o privados sean necesarios o convenientes para la obtención del Certificado electrónico de representante de persona jurídica de la entidad denominada [ nombre de la sociedad ] de la autoridad certificadora correspondiente, conforme a lo establecido en la Ley 59/2003, de 19 de diciembre, de Firma Electrónica, la Ley 39/2015, de 1 de octubre, del Procedimiento Administrativo Común de las Administraciones Públicas y demás normas o leyes complementarias. En especial, podrá hacer cuantas gestiones sean necesarias ante los órganos que correspondan para la obtención del Certificado de Usuario expedido por la Fábrica Nacional de Moneda y Timbre. Para ello podrá firmar los documentos públicos y privados que sean necesarios para el cumplimiento de este fin.
- Erica Eced Martinez with National Identity Card number 35594222C is allowed to apply and manage the public and private documents needed in order to apply on behalf of [ company name ] for an electronic certificate, according to what is established in Law 59/2003, dated December 19th, Law 39/2015, dated October 1st and whatever other complementary laws. In especial, the representative is empowered to do whatever it is necessary to obtain the User's Certificate issued by the "Fábrica Nacional de Moneda y Timbre". For this purpose, the representative is allowed to sign any public and private documents required.
- Facilitar la práctica de cuantas actuaciones sean precisas para la instrucción de cualquier expediente;
- Facilitate all activities necessary for the beginning of any VAT proceeding;
- Aportar cuantos datos y documentos se soliciten o se interesen;
- Provide the Tax Authorities with any document or data required;
- Recepción de notificaciones electrónicas (implica el consentimiento a la práctica de notificaciones electrónicas al apoderado y la posibilidad de que el apoderado pueda señalar los días en los que la Agencia Tributaria no pueda poner notificaciones en la dirección electrónica habilitada);
- Receive electronic notifications (implies giving consent to send electronic notifications to the representative and the possibility of the latter to inform about the days when the Tax Authority cannot place notification in the e-address).
- Formular peticiones y solicitudes, presentar escritos y alegaciones así como recursos y reclamaciones;
- Formulate petitions and claims, present applications and allegations;
- Manifestar su decisión de no efectuar alegaciones ni aportar nuevos documentos en el correspondiente trámite de audiencia o renunciar a otros derechos;
- Manifest its decision of not presenting allegations or not lodging new documents in front of the corresponding Tax Authority or to resign to other rights;
- Suscribir diligencias y otros documentos que pueda extender el órgano competente en el curso de un procedimiento y, en general, realizar cuantas actuaciones correspondan al/a los representado/s en el curso de dicho procedimiento;
- Subscribe diligences and other documents that can be issued by the competent authority and, in general, to undertake any measure concerning the represented company in the course of a VAT procedure;
- Solicitar y obtener la devolución de cualquier cantidad de la que pudiera resultar beneficiaria la Sociedad otorgante, incluidas devoluciones de ingresos indebidos, por razón del IVA, percibiéndola, en su caso, a fin de reintegrarla a la Sociedad otorgante.
- Request and obtain refunds, including those referred to amounts unduly paid, of any sum which may be owed to the granting company in respect of VAT, receiving them where appropriate for the purpose of reimbursing them to the granting company.
- Solicitar la asociación de un número EORI al Número de Identificación Fiscal (N.I.F.);
- Request the link of an EORI number to a Spanish Tax Identification number;
Responsabilidad / Liability
La sociedad otorgante exonera al representante de toda obligación y responsabilidad en el supuesto de que la información facilitada al representante no fuera veraz, fuera incompleta o no hubiera sido facilitada adecuadamente, en tiempo y forma o sin la debida provisión de fondos. Asimismo, el otorgante expresamente exime a Erica Eced Martinez de cualquier responsabilidad derivada del ejercicio de su representación que no sea imputable a una actuación negligente de la misma, así como a reembolsarle cualquier cantidad que, por tal motivo, pudiera serle exigida.
The company exonerates its representative from all obligations and liabilities in the event that the information supplied to the representative proves to be incorrect, incomplete or was not supplied at the right time and in the right form or without the due provision of funds. Moreover, the grantor expressly agrees to release and hold harmless Erica Eced Martinez from any liabilities not directly imputable to the negligent conduct thereof which may derive from the exercise of its functions as VAT representative and to reimburse any amounts that Erica Eced Martinez might be required to pay as a result of such representation.
